After a four day preliminary hearing, Duane Morgan was free to go after
being charged with the murder of a Windsor High School sophomore. The
teen, who Attorney Joseph Bisbiglia represented, was discharged after
the judge ruled that there was insufficient evidence.
The prosecutor attempted to link Morgan to the killing by claiming that
his membership in a gang, presence at the scene, and possible participation
in the fight was sufficient evidence. However, with Attorney Bisbiglia’s
litigation, it was evident that there was no evidence that Morgan engaged
in the fight, despite his strong gang participation. Two teens are still
being held responsible for the killing and face life in prison if convicted.
It is rare for someone to be discharged at this stage of the case and,
in doing so, Attorney Joe Bisbiglia has set a huge precedent for the level
of advocacy he can deliver. While it is good news for his client, Joseph
is still mindful of the tragic loss within the case.
