How To Get An Expungement in CA

In California, a criminal record is not actually expunged. While expungement implies complete erasure, a more fitting term is “dismissal.” If you were convicted of an infraction, a misdemeanor, or a felony and were not sentenced to state prison, you can petition for a dismissal.

If you never received probation, you must meet the following requirements:

  • You were convicted of a misdemeanor or an infraction
  • At least one year has passed since your conviction
  • You are not currently serving another sentence
  • You are not being charged with another offense

You are still eligible for a dismissal if you received probation but did not get an early release or did not fulfill all the conditions of your probation, but the court will have full discretion over this.
